Is Apple the Pioneer and the Best?

In 1994, Apple Computer Inc. filed a case against the Bill Gates owned Microsoft Corporation for copyright infringement, to prevent it from using the visual graphical user interface (GUI) elements that were similar to those in Apple's Lisa and Macintosh Operating System. The jury said, "Apple cannot get patent-like protection (under the copyright law) for graphical user interface". The same was the case when Apple had filed a "copyright infringement" case against Hewlett Packard. Since then, it has been routine for Apple to look at any other company which manufactures computers as copying their products.

When Apple entered into the field of smartphones in 2004 and released their first iPhone with the "multi-touch" feature in 2007, it became super popular. On 27th April 2009, Samsung Electronics revealed their first ever smartphone (Samsung Galaxy; i7500) running on Google's Android operating system. This is when competition between Apple and Samsung started.

Both the American and Korean companies went on innovating and manufacturing the best smartphones they could give to consumers and to the smartphone ecosystem. In March 2010, Samsung announced its new smartphone (Samsung Galaxy S) running on Android 2.2, which became really popular. Samsung then went on to increase its market share by announcing Samsung galaxy S advance, Galaxy S Plus, which were improved versions of Galaxy S. Later, at the Mobile World Congress, it announced the Samsung galaxy S II (Samsung's flagship model for 2011) on 13th February 2011. This again was a major hit. With the release of Galaxy S-II, Samsung grabbed the biggest share of smartphone market in the first quarter of 2012. The worldwide smartphone market grew 42.2% year over year during the first quarter. According to an IDC (International Data Corporation) estimate, Samsung Electronics had overtaken Apple for the "Leading Smartphone Producer" position.

Samsung sold 42.2 million smartphones, which is a new record, while apple sold only 35.1 million smartphones during the first quarter. This means about every second smartphone sold across the world came from either Samsung or Apple. Samsung also supplies the touch screens for the iPad after LG Display Co. and Sharp Corp. dint meet the US company's quality requirements. The supply deal deepens Apple's partnership with Samsung, which already makes the chips that power the iPhone and iPad, even as the companies sue each other for copyright infringements.

Apple is simply being jealous of Samsung's success and reputation. Its reasons for suing Samsung is baseless. It says it has problems only with the design and physical traits of Samsung's smartphones only because it has rounded edges and some icons resemble. That's something which is completely preposterous. If today, there are no cars in the entire world and I am the first one to launch the first car of the world called the "BMW M3", which is actually a sedan. And, later another company, i.e, Mercedes Benz launches the second car of the world, which is also a sedan. I can't simply go and  sue Mercedes saying that it has infringed my design patents. Going by the history of Apple, as i have mentioned above, apple had sued almost all of its competitors, whether it may be in the field of manufacturing computers or smartphones. It has sued Microsoft, Hewlett Packard, Samsung, etc. Recently Apple had sued Motorola stating that, "Motorola has infringed around 40 patent rights of Apple". Even though Apple did not succeed in winning the case against Microsoft, Hewlett Packard, Motorola, etc. It continued in suing Samsung. But, apparently Apple won against Samsung.

Google says it has nothing to do with the case. In my opinion I believe all the innovation is from Samsung. Apple (the plaintiff) is nothing but a small hurdle in the major innovations of Samsung. To support this let me just bring to you the specifications of the new devices launched by Samsung and Apple together and see from where, really, the innovation is from.

It has been really very rare, in the history of law, that companies have won on the basis of "patent of design". But Apple has, and seems to be really foolish and not fair on the side of Samsung.

Now it depends upon you. Whether you would still continue buying Apple and be obsessed with a phone which is "one of the best smartphone or tablet" or buy and enjoy the "best smartphone or tablet".
